Fleury, Nicolle M

Deputy Chief Counsel

Nicolle Fleury became the Deputy Chief Counsel of the Federal Highway Administration on January 3, 2016.  In this position, she supervises and coordinates the activities of a staff comprised of 58 employees, of whom about 50 are attorneys responsible for providing legal services regarding all aspects of the FHWA\'s programs.  The Office of Chief Counsel consists of three headquarters divisions and five field divisions, four of which provide services to Federal-aid Division Offices and the Resource Center, and one that provides services to the Federal Lands Highway.  Nicolle directly advises the most senior officials in the FHWA and the U.S. Department of Transportation.  Nicolle and her staff work with State and local government transportation attorneys and other customers to enhance their understanding of Federal laws and procedures relating to transportation.


From December 2011 to December 2015, Nicolle served as the Assistant Chief Counsel for Legislation, Regulations, and General Law.  In this position, she was responsible for overseeing legal services related to delivering FHWA\'s legislative program, developing and coordinating regulations, matters concerning appropriations and fiscal law, and matters related to FHWA\'s internal programs. 


Prior to becoming Assistant Chief Counsel, Nicolle served as a Senior Attorney Advisor in the Program Legal Services Division of the Office of the Chief Counsel, where she focused on legal issues concerning the American Recovery and Reinvestment Act of 2009 and the National Infrastructure Investments (TIGER) grant program.  From July 2007 through January 2009, she held the position of Special Counsel to the General Counsel working on aviation congestion issues and surface transportation reauthorization.  From September 2004 through June 2005, Nicolle served as Special Counsel to the Chief Counsel, concentrating on issues related to public-private partnerships.  Nicolle began her career at DOT as an Attorney Advisor with the Legislation and Regulations Division of the Office of the Chief Counsel. 


Nicolle began her legal career working for the Maryland Department of Legislative Services, which provides nonpartisan professional services to the Maryland General Assembly.  She spent the majority of the time with the Department of Legislative Services primarily as Committee Counsel to the Senate Budget and Taxation Committee.  Nicolle worked on a wide variety of issues including transportation, environment, natural resources, agriculture, property taxes, and other fiscal matters.


 During her time with the Department, Nicolle has received numerous Secretary and Administrator\'s awards including the Secretary\'s Gold Medal Award for the Aviation Congestion Team, the Superior Achievement Award from the Office of the General Counsel, and the Administrator\'s Achievement Award, as well as several team awards.


Nicolle received a Bachelor of Science in Foreign Service from Georgetown University and a Master of Arts in International Affairs and a Juris Doctor from the University of Denver.  She is admitted to practice in the State of Maryland.  Nicolle also is a member of the Senior Executive Service.
